| 摘 要： | 判例法的精髓在于创制法律规则,而不仅仅是“遵循先例”,从这一视角认识判例法,我国存在判例法制度。判例法是中华法系不可或缺的组成部分,新中国诞生后,并未改变判例法存在的社会基础,判例法存在有其必然性和必要性。判例法的发展与完善是我国法制建设的当务之急。

| Abstract: | The soul of precedent law is to create the rules of law,not only to abide by s tart decision.Seen in this view,precedent law does exis t in China' s law system and has become an indispensable part of sino -law system.As precedent law' s social bases have not changed ever s ince the foundation of the People' s Republic,its existence in China is a n inevitability and necessity.Therefore it is imperative for us to develop and improve the precedent law which c onstructing China' s legal institution. |
