未成年人犯罪案件侦查环节程序分流研究

未成年人犯罪的原因是多方面的,而且大都属于家庭、社会等外在不良因素的影响,因此,对于这些未成年犯罪人如果一味坚持适用常规的刑事司法程序和处罚结果,往往适得其反,一方面不能满足刑法的预防目的,另一方面也会导致司法效率的低下,与刑法的谦抑性不相符合,针对未成年人犯罪案件特点在侦查环节对一部分案件进行分流,不失为一种妥当的做法。

The causes of the juvenile delinquency is various,but most belong to the family,or society factors,therefore,for those minors who stubbornly adhere to the applicable criminal conventional criminal justice procedures and penalties result,often counterproductive,on the one hand,criminal law can not meet the purpose of prevention,on the other hand it would lead to the low judicial efficiency,which does not accord with the extreme nature of the inconsistent penal code,according to the characteristics of the juvenile delinquency,it is a proper approach to make procedure distributaries for some cases.
