试论盗窃信用卡并使用简

本文以盗窃信用卡并使用中的盗窃行为和使用行为以及我国现行相关法律规定为研究对象加以分析.拟涉及以下诸内容：以我国刑法文本为基础,讨论刑法学界对《刑法》第196条第3款规定的理解;以全国人大常委会2004年关于信用卡的立法解释为依据,斟酌其中“信用卡”的定义;使用遗留在自动柜员机内的信用卡的行为;明知是他人盗窃的信用卡并使用;盗窃信用卡并使用是否存在转化型犯罪.

Analysis of Stealing and Using Credit Cards

This paper is based on stealing credit card which indicates the behavior of theft and usage, and the current relevant laws and regulations as the research object. The article involves the following contents ： On the basis of Chinese criminal law text, discussing the criminal educational world how to understand paragraph 3 of article 196 of criminal law; To the standing committee of the National People＇s Congress in 2004 on the basis of the legislative interpretation on credit cards, considering the definition of ＂credit card＂; Using the credit card that is left in the ATM; Knowing others who owns the credit card and using it; Stealing the credit card and using it, which exists transformation type of the crime.
