| 摘 要： | 2012年修改后的《刑事诉讼法》对警察出庭作证做了相关的法律规定,使得警察出庭作证有法可依。然而,法律并没有对警察出庭作证作出详细的规定,这就使得警察出庭作证成为学术和司法实务界探讨的热点话题之一,主要对警察有无必要出庭作证、以什么样的身份出庭作证以及对出庭作证具体法律问题的理解存在有争议。

| Abstract: | Regulations on policeman as a witness on the court are written in the revised Criminal Procedure Law of 2012. However,there are not detailed provisions on policeman as a witness,which makes how policeman being a witness become hot topic in academic field and juridical practice. There are disputes on whether it is necessary for policeman to be a witness,what identity the policeman is to be a witness and the understanding to some concrete legal issues. |
