法哲学视角下正当性的历史考察

从历史的维度梳理法哲学领域关于"正当性"与"合法性"的争论,逻辑领域关于"合理性"与推理"正当性"的争论、伦理领域关于行为"正当性"标准的争论,一方面以主要学者的代表性观点为线索演示"正当性"在上述学科领域的内涵变化并做出评价,另一方面试图在分析历史争论的基础上,抽象出"正当性"内涵分歧(不同学科领域和同一学科领域内部)的统一实质,即事实与价值的关系问题,并认为尽管事实与价值在一定程度上存在断裂,但在属人的领域,必须对事实进行价值追问。

Historical Research of Legitimacy from Philosophy of Law Perspective

From a historical dimension to do researches on legitimacy and legality in philosophy of law field, rationality and legitimacy by reference in logic field and the standard of legitimacy on behavior in ethic field, which include two aspects： first, it takes the typical ideas of main scholars to demonstrate and evaluate the connation change of legitimacy; second, it tries to abstract the unified essence of the connation difference of legitimacy on the basis of analyzing historical arguments, that is the relationship between facts and values. And it is thought that it has to do the research on facts through values refers to human beings even though there is a incoherence of facts and values to some extent.
