刑法分论教学改革的若干问题探析

摘    要:按照刑法典分则体系的规定顺序来组织刑法分论教学的传统教学模式存在诸多弊端,不能很好培养学生解决实际问题的能力,也会阻碍教师新知识的更新。改革刑法分论的传统教学模式,在传统侵犯人身权利罪和侵犯财产权利罪的基础上,根据分则规定的不同犯罪的行为特征、罪与罪的相关联性、近似性,并考虑罪的发生率将分则规定的犯罪进行归类;然后依该分类标准逐一组织讲授,并以案例教学法为依托,引导学生思考、讨论重点和难点问题,强化师生之间的互动,以取得好的教学效果。

Abstract:There are many drawbacks in the traditional teaching model to organize the teaching way according to the provisions of sub - rule system in the Penal Code, it can not foster the students' ability to solve practical problems well, it may also discourage teachers to get new knowledge. We should reform the traditional teaching model on the criminal law theory part , based on the traditional crimes and the crime of property rights violation the different provisions of sub - criminal behavior, crime and the crime associated with sex, approximate nature, and to consider the crime of provides that the incidence of crime will be categorized ; and then one by one organization in accordance with the classification standards of teaching, and to rely on case teaching, guiding students to think, to discuss priorities and difficult problems, and strengthen the interaction between teachers and students in order to obtain a good teaching effectiveness.
