| 摘 要： | 第十一届全国人大常委会审议并通过了《中华人民共和国侵权责任法》，其中医疗损害责任的内容引起了社会各界的广泛关注。可以说这是对我国现有医疗纠纷处理法律制度的完善与重要补充。以此就比较集中的若干问题进行分析和阐述，以期新法可以促进和谐医患关系的构建。
