| 摘 要： | 分析诉辩交易制度的基本特征,从司法公正与效率角度出发,探讨诉辩交易在我国刑事诉讼中存在的价值。在我国的司法实践中,采用诉辩交易制度面临严峻的挑战:(一)法律的缺陷与司法解释的不足;(二)法律移植的本土化。
