| 摘 要： | 报应刑所实现的法律正义可能是一个矛盾,难以实现“恶法亦法”情况下的社会正义。这一矛盾难以在实行积极的罪行法定原则的我国刑法内部得到解决。缓和这一矛盾的理想途径是通过对《刑法》第十三条的但书进行解读,并制定相应的法律措施,尽量减小报应刑实现法律正义可能带来的负面影响。

| Abstract: | Retributive punishment maybe implies a paradox,whose aim can't be achieved when the penal law itself is not just.It is difficult to resolve this paradox inside our country's penal law which implements positive principle of legally prescribed punishment for a specified crime.The best way to relax this paradox is via the 13th provision of the penal law. |
