略论刑事受害人补偿制度

目前，我国正处于社会转型时期，暴力犯罪处于高发态势，给被害人及其家庭造成惨痛损失。由于大多数加害人经济状况差，赔偿很难实现，引发一系列社会问题：被害人家庭生活陷入严重困境：被害人及其家属不满和报复情绪严重，持续上访，给社会造成新的不稳定因素；导致民众对司法机关的不信任等等。“少杀慎杀”思想的逐步确立以及死刑复核权的回收，使对受害人进行经济上的补偿和心理上的安慰愈加重要。在私人赔偿无法实现、社会捐助没有保障的情况下，国家应该承担起对刑事受害人的补偿责任。

On the Criminal Victim Compensation System

Currently, the social transformation causes a growing number of violent crimes which brought great losses to the victims and their families. Because the infringers are mainly in miserable economic condition, the compensation can hardly be realized which evokes a series of social problems： the victims＇ families fall into serious trouble, victims and their families have serious revenge emotion, and finally it causes people＇s distrust to judicial organs. Therefore, establishing the thought of ＂sentencing or executing death penalty less and carefully＂ and recovering the competence for judicial review of death sentence would comfort the victims economically and psychologically. In private, when social donation compensation cannot achieve security situation, countries should undertake the responsibility for criminal compensation.
