我国未成年人社区矫正的瓶颈与突破简

鉴于未成年人心智尚不成熟,极容易在鱼龙混杂的监狱中受到监狱亚文化的侵蚀而形成“监狱人格”,导致其再次触犯法网.社区矫正因其具有非监禁性、社会参与性等特点,可以更有效地矫正未成年人犯罪心理、预防重新犯罪.尽管未成年人社区矫正已取得一定成效,但是仍存在立法空白、保障机制及专业的矫正方法欠缺等问题.因此,如何完善我国未成年犯社区矫正制度是当下亟须解决的问题.

On the Bottleneck and Breakthrough of Minors＇ Community Correction in China

With immature minds, minors easily develop into ＂prison personality＂ by the erosion of prison sub- culture, which leads to violation of laws again. With non-imprisonment and social participation, community correction can better correct minors＇ criminal mentality and prevent minors from crimes again. Although China has made achievements on minors＇ community correction system, it still has problems such as blank legislation, scanty safeguard mechanisms and specialized correction means. Therefore, it is urgent to improve minors＇ community cor- rection system in China.
