| 摘 要： | “行政国家”这一术语彰显了行政权扩张的现实，政府承担了越来越多的公共职责。这种现象的出现是经济社会发展到一定的阶段的必然产物，但也对传统的行政权的定位以及行政管理体制，尤其是行政运行机制带来了严峻的挑战。行政运行机制必须进行重塑才能回归政府本来的角色，避免因行政权扩张而对其他国家职能的腐蚀，以及违反民主宪政体制和侵犯公民权利。

| Abstract: | The administrative state highlights the reality of administrative power extension the government takes more public functions, which is the result of social and economic development at a certain stage. But it also brings severe challenges to traditional positioning of administrative power and administrative system, especially to the administrative function mechanism. It is necessary to rebuild the administrative function mechanism so as to avoid the corrosion of other functions of the state, the violation of constitutional system and intrusion of civil rights. |
