检察机关纠防超期羁押工作的回顾与思考

近年来,检察机关认真履行法律监督职责,使超期羁押这一司法顽症得到初步遏制.但是,当前纠防超期羁押工作仍面临"前纠后超"、隐性超期羁押突出等问题.这需要公检法机关进一步更新理念,加大纠防超期羁押工作合力;检察机关应充分发挥在纠防超期羁押工作中的法律监督职能作用;加强纠防超期羁押长效机制建设;完善羁押法律制度,堵塞法律漏洞.

Retrospect and Reflect of Procuratorial Work to Correct and Prevent Overtime Detainment

The procuratorial organ has kept overtime detainment,which is considered as one of the persistent ailments in judicial practice,within limits by earnestly performing its responsibility of legal supervision, while serious problems such as "overtime following correction" and concealed overtime detainment still exist.The public security organ,the procuratorial organ and the court should renovate relevant notion to enhance the resultant force;the procuratorial organ should sufficiently exert the responsibility of legal supervision in correcting and preventing overtime detainment;it should strengthen the development of a long-term mechanism,perfect current laws and build up legal loophole.
