论我国社会转型时期领导职务行为的法律规制

依法治国要求依照宪法和法律的规定来治理国家、管理社会事务，要求领导人的职务行为必须服从于宪法与法律。由于我国历史上长期人治思想的影响，领导职务行为中的“乱作为”与“不作为”现象不仅为数不少，有些性质还相当严重。因此，必须推行领导职务行为过错责任追究制度，并从行为前的“自我控制”、行为中的“监督控制”和行为后的“惩罚矫正”入手，规范领导干部的职务行为，实现我国建设社会主义法治国家的宏伟目标。

On Legal Regulation of Leadership Behavior during China's Social Transition Period

Governing the country according to the law requires to rule the country and manage social affairs in accordance with the constitution and the provisions of the law,and the leaders'official conducts must be subordinate to the Constitution and the law,too.As the long-term impact of ruling by people in our history,the phenomenon of"the chaotic achievement"and"not perform"in leaders'duty behavior not only consists of a considerable number,but some are quite serious in nature.Therefore,we must carry out the fault accountability system for leadership positions,and we should begin with"self-control" before the behavior,"supervisory control"during the behavior,and"punitive correction"after the act in order to standardize the duties of leading cadres,and to construct a socialist country under the rule of law for the grand goal.
