社区矫正试点与矫正质量的提高

社区矫正是组织社区的力量 ,对符合在非监禁条件下接受矫正的罪犯实施刑罚的活动。社区矫正的试点应当紧紧围绕提高矫正质量 ,在平衡各方利益的前提下谨慎操作。试点工作一定要重心下沉 ,解决好街道怎么办、居 (村 )民委员会怎么做等实际问题。对我国社区矫正的试点成果采取谨慎乐观的态度较为可取。社区矫正工作队伍的组建 ,社区矫正工作与劳动教养制度改革关系的处理 ,防止社区矫正对象对社会的“逆向感染” ,被矫正人员的权利保障等尚未引起足够重视的问题 ,亟待在试点工作深化阶段予以解决。

The Experimental Community-based Corrections Should Emphasize On the Improvement of Correction Quality

community-based corrections refer to the execution of punishment to the criminal who complies with the standards of accepting the corrections under the non-imprisonment conditions in their communities. The experimental community-based corrections should focus on the improvement of the correction quality, and take scrupulous measures based on the balancing of each party's interests. The experimental activity shall solve the practical issues on what subdistrict office shall do and what neighborhood commission shall do. It is wise to hold prudentially optimistic attitude toward the existing achievements of the experimental community-based corrections in China. The followings are the key issues which should be solved in the further stage of experimental community-based corrections:the organization of the working team of community-based corrections, how to deal the relationship between community-based corrections and reeducation through labor, how to prohibit the correction members from infecting the society reversely and how to protect the right of the correction members.
