摘 要: | 在高校与学生之间出现争议时,进一步完善权利的法律救济途径为正确的应对之策,然而,寻求司法救济并未成为一般性的途径,原因在于社会对司法救济的功能存在置疑。通过对分析大学自治与司法审查关系,界定教育诉讼的可诉性范围,是保持司法救济理性的重要前提,也是解决中国大学目前存在的许多产生弊端问题的慎重选择。

Abstract: | Judicial remedy doesn’t become the general approach as the settlement of dispute between universities and students.The main reason is that people doubts the function of Judicial remedy. It is an important premise to define the suable field of educational litigation by the analyzing the relationship of college autonomy and judicial review. Meanwhile, it is also careful choice for resolving many serious problems of universities in China. |
