"战略环评"法律问题研究

我国虽然颁布了《环境影响评价法》 ,规定了规划的环境影响评价这种战略环评 ,但其规定很不具体 ,在具体实施中会遇到许多问题。其中战略环评适用的对象范围、战略环评的责任人和评价单位、战略环评的审查、违反战略环评要求的责任追究等问题是特别需要研讨的问题。国外在战略环评方面已经有了比较成熟的立法 ,我国应对此予以借鉴。

The Legal Study on the Tactical Evaluation of Environment

Though the law on estimation of the environmental influence is enacted in our country, it does not prescribe specifically and many problems come out when it is put into practice. Above all, there are some questions as follows we must study, including the range of applicable object, the subject taking on the responsibility, the corporation estimating the environmental influence, the examination of the tactical evaluation, the investigation of responsibity, and so on. And in some foreign countries, there some advanced legislation we can learn.
