对向犯视角下的商业贿赂犯罪

今年,全国上下开展打击商业贿赂活动,检察机关、行业监管部门多管齐下,媒体网络更是一片征讨之声,医疗、机械、建筑等行业的商业贿赂行为一时间变得无所遁形。实质上,商业贿赂既不是规范的法律术语,也不是准确的刑法罪名,但却是刑法中对向犯的典型表现形式。本文试图转变传统刑法的研究视角,从对向犯的角度研究商业贿赂犯罪的特征及预防措施,希望能够对进一步规范社会主义市场经济秩序,使市场竞争主体按照现有的显形规则经营运作有所帮助。

The Problems of Business Bribe In Terms of Mutual Crime

This year, the government pays more attention to the problem of business bribe. The organization of public prosecution and the supervisor of every trade coordinate to check all kinds of crime involving bribe in medical, education, building and so on. Actually, the business bribe is neither a formal legal term, nor an accurate criminal charge. But it is the typical model of mutually crime. The author will change the tradition method into researching the character of the business bribe and the measurement to prevent these crime so as to norm the socialism market economy order and make market competition corpus can operate according to the formal rule.
