| 摘 要： | 违法性,应当成为侵权构成之独立要件.侵害了法律所保护的利益,行为即具有违法性.行为违法与否取决于法律保护之利益范围,同时,法律对不同利益的不同保护力度,决定着违法性的程度.与评价行为人主观心态的过失不同,违法性涉及的是客观层面上是否有法律所保护的利益受到侵害.违法性要件具有划定行为自由空间,保障正当利益,以及型塑权利的功能.

| Abstract: | Illegality should be an independent element of the tort composition.Violation of a legally protected interest is illegal.Illegality depends on the legal protection scope while the protection degree determines the extent of the illegality.Negligence is a subjective concept,but illegality is an objective concept.Illegality has three functions:delimit the behavior free space,protect the legitimate interests and create rights. |
