| 摘 要： | 拒绝作证行为具有一定的社会危害性,有悖于我国宪法和法律的有关规定,为了弥补漏洞,维护法律权威,保证刑事诉讼活动正常进行,我国应在刑法中增设证人拒绝作证罪。

| Abstract: | Refusal to witness,to some degrees,is of social harm,which goes against the Constitu tion and concerned laws.In order to make up the legal loop holes and maintain the authority of laws,to guaran-tee the normal criminal procedural activities,the crime of wit ness' refusal to witness should be added to the Criminal Law. |
