哈耶克自由主义法哲学思想研究

法哲学是法治时代政治文明精华的体现,法治时代是一个迈向权利的时代,更是一个迈向自由的时代,自由当是我们时代精神最为集中的体现。哈耶克批判地继承了前述理论家们对法律与自由关系的论述,总结前人的思想,艰苦钻研得出了自由就是法律的目的的精辟结论,哈耶克坚信法就是作为理念的自由。他的所有的对于法治理论的论述都是为了"自由"这个目的而准备的。虽然哈耶克是以一个资本主义制度顽固的捍卫者身份登上历史的舞台,但是他对待学术所表现出来的鞠躬尽瘁的态度和为现代法治研究探索做出的努力还是值得所有学者肯定和赞赏的,并且为我国正处于改革时期的法治建设提供了理论依据,深入研究哈耶克的自由主义法哲学思想,无论在理论上还是实践上、无论是对全世界的公民们还是对法哲学思想家们,这都是意义重大的。

Study on Hayek's Liberalism Philosophy of Law

Philosophy of the law is embodied political civilization in the era of the rule of law,the era of the rule of law is a moving towards the right era,and towards an era of freedom,and the spirit of liberty is the most concentrated expression of our times. Hayek critically and inherited the preceding theorists that is the law and freedom idea,summary of previous ideas,we must study hard that we can obtained the freedom is legal purposes incisive conclusions,Hayek believes the law is the concept of freedom. For all of his theories,they are discussed in the rule of law in order to ＂free＂ prepared for this purpose. Although Hayek is one stubborn defenders of the capitalist system identity boarded the stage of history,but he treats academic spared no efforts and for the study of modern exploration is worth all the efforts made in recognition and appreciation of academics,and provides a theoretical basis for the rule of law when China is in the construction of the reform period,in-depth study of Hayek’s liberal philosophy of law,both in theory and in practice,both for the world’s citizens or for the Philosophy of Law that is significant.
