物权法不宜规定征收、征用制度

征收、征用权虽然是一种超越私权的独立权力,但在现代社会,法律确认或规定征收制度的意旨不在于强调此权力的合理性,而在于如何限制其对私人财产权所可能造成的剥夺与限制。世界各国因此在以宪法对征收加以确认之同时,多制定系统的征收征用法。将与物权法规范异质的征收制度规定进物权法,既会加剧我国征收征用制度的混乱,又会破坏物权法的纯洁性、科学性,同时也可能降低人们对限制征收征用权之必要性的认识。应加紧制定系统的征收征用法。

The Jus Rerem Should Not Stipulate The System of Levy And Expropriatiln

Although the power of levy and expropriation is an independent power surpassing the private right,the intent of the law to confirm or stipulate the expropriation system is not to stress the rationality of the power,but to confine the possible divestment and restriction to private property.in modern society,Therefore,when they confirm the expropriation system by the constitution,most of the countries in the world also enact the systematical law of levy and expropriation.Specifying the expropriation system in the jus rerem which is heterogeneous to it will not only aggravate the confusion of the expropriation system in our country but damage the purity and scientificity of the jus rerem,while probably abate people's cognition of the necessity of the power of levy and expropriation.It is urgent to promote the legislation of the levy and expropriation law.
