The Struggling Prospects of "Transferring Guarantee" in the Property Law

Transferring guarantee is a kind of nontypical guarantee. In recent years, it has played an important role in economic life. However, it is controversial as to whether transferring guarantee ought to be codified in the Property Law. This thesis(author) argues that the transferring guarantee has better prospects in the Property Law than ever through 1) comparing transferring guarantee with chattel mortgage, pledge, and 2) examining the functions, characteristics, and nature of transferring guarantee, and the trend of security interest in our country.
