“云计算”的法律问题及其对策

云计算本质是新型的信息服务模式,它既改变了用户设备、软件的支配关系,也使用户对数据丧失了直接的掌控能力。因此,云服务引发了许多新的法律问题,如信息安全、数据权利、知识产权、司法管辖。云服务问题仍然植根于信息通信技术应用产生的问题,我们必须从技术、标准、法律、商业等多角度,解决云计算机的安全和相关问题,以消除我国信息技术的应用方面的法律障碍。

Legal Problems from Cloud Computer and Relative Resolutions

Cloud Computer,as a new form of information service in nature,has changed the control capacity of user not only to hardware & software,but also to the data generated from the service.Therefore,cloud service has raised lots of legal problems,such as information security,data right,intellectual property,jurisdiction etc.It is argued in this paper that these legal problems result essentially from the application of information and communication technology,and should be solved with technology,standard,law and business method jointly so as to clear the legal handicap for application of information and communication technology.
