浅议我国刑事司法精神病鉴定启动程序的完善

本文分析了我国刑事司法精神病鉴定启动制度存在的四方面弊端．在比较借鉴英美法系和大陆法系的立法和实践成功经验的基础上．对我国刑事司法精神病鉴定启动制度改革提出了一些粗浅的建议：应赋予辩方刑事司法精神病鉴定的启动权，对于补充鉴定和重新鉴定应规定明确的标准和次数限制，实行强制鉴定制度，建立统一的司法鉴定人职业资格考试和执业资格考核制度，健全鉴定人出庭作证制度等。

On Perfection of the Starting Procedures of Forensic Psychosis Identification of China
