| 摘 要： | "经济往来"系列条款在商业贿赂犯罪的研究中占有重要的地位。理解"经济往来"系列条款时,要注意条款所涉个罪均必须以"利用职务上的便利"、"为他人谋取利益"、"谋取不正当利益"作为条件。"账外暗中"作为刑法第387条第2款所明确规定的单位受贿罪的成立条件,不太合理,该限定条件不利于惩治犯罪。

| Abstract: | Criminal Law Sections involving economic relations play an important role in the research of commercial bribe crimes.The crimes in these sections must possess the following conditions: to utilize one's powers;to benefit the commission person;to seek the improper profits.Item 2 of Section 387 of Chinese criminal law is not suitable and should be improved. |
