| 摘 要： | 我国虽然在现有劳动争议处理程序的各个环节都对工会的作用作出了相关规定,但由于工会缺乏独立性、劳动争议处理程序缺乏法律的强制性保障等原因,工会参与劳动争议处理大多流于形式,应逐步完善工会参与基层劳动争议调解机制,切实发挥工会维权职能。

| Abstract: | At present, because of lack of independence of the trade unions, trade unions can not play a substantial role in the handling of labor disputes. So it is of vital significance to gradually improve the mediation mechanisms of grass-roots labor dispute and effectively play the safeguarding functions of trade union. |
