| 摘 要： | 所有权是渔业权等他物权的母权,是所有权与其权能分离的属性和理论、所有权的弹力性的变形表现。所有权与他物权分类的目的及意义可以因时代的要求及研究者拟解决问题的需要而发生变化。水资源所有权在我国现行法上为一个同一的、抽象的所有权,实务上至今没有提出数个水资源所有权的要求。 |
