审判委员会改革与合议庭权限

刑事诉讼法、人民法院组织法、有关司法解释规定了人民法院内部监督的性质和讨论决定案件的程序.但学界对审委会的性质有不同观点,对审委会讨论决定个案有肯定说、改革说和否定说之争.审委会讨论决定案件有利有弊,但弊大于利,应当改革.审委会应当履行审判案件管理之责,不应当再讨论决定合议庭审判的案件,并将此权真正还权于合议庭.

Reforming the Judicial Committee and the Responsibilities of the Collegial Panel

It has been prescribed in the criminal procedure law,the organization law of the people's court and relevant judicial interpretation the interior supervision in the people's court and process of discussing and deciding cases.However,different ar- guments about the nature of the judicial committee still remain in the theoretical research including affirmative,reform and neg- ative opinions.In fact there are lots of disadvantages and advantages in the judicial committee operation process,yet the advan- tages are overweight the disadvantages thus it is necessary to reform the judicial committee.The judicial committee should in charge of administration rather than deciding cases so that return trial power to the collegial panel.
