| 摘 要： | 生态补偿是环境保护法学领域研究的热点和难点,但其定义至今尚未统一。文章围绕生态补偿的目的、补偿主体与标的、补偿依据与形式等几个方面,探讨了以往生态补偿费的定义;然后分析了已有生态补偿的定义;最后,从权利与义务的角度给出了对生态补偿涵义的理解。

| Abstract: | Currently,the ecological compensation has been a hot and difficult point in the realm of environmental protection,but its conception hasn't been unified up to now.From such aspects as the compensational purpose,the subject,the object,the cause and the means,this paper first inquiries into the preceding definitions of the ecological compensation levy,then analyses the preceding definitions of the ecological compensation,finally gives the law connotation of the ecological compensation from the angle of the right and the duty. |
