公安行政听证程序实践适用探析

听证制度是行政程序法基本制度的核心。《公安机关办理行政案件程序规定》虽然对公安行政听证程序作出了进一步的规定,但公安行政听证程序的法律定位、适用范围、告知程序、主持人的确定等方面仍然存在些许不足,在公安行政管理中听证程序仍有被弱化甚至忽略的可能。依法强化公安行政听政制度、充分保障当事人合法权益有着重要现实意义。

The hearing system makes the core of administration procedural systems.Although the"Rules on Procedures Followed by Public Security Organs in Handling Administrative Case"has further regulated the hearing procedures of public security administration,there're still some defects in the aspects such as its legal orientation,scope of application,informing procedure,ways to decide the president,and so on,thus the hearing procedures can possibly be weakened and ignored in the administration management of public security organs.Therefore,it's of great significance to strengthen this system for fully protecting the legal rights of parties.
