动产善意取得制度逻辑前提之重构

Reconstruction on the Logic Premise of Bona Fide Acquisition on Chattel

According to the viewpoint of traditional theory on civil law, the logic premise of bina fide acquisition on chattel is “occupation represents ownership”. But with the generalization of the phenomena of separation of occupation from ownership, occupation isn’t never been considered the appearance of ownership, which destroys the base of bina fide acquisition on chattel. From the re-understanding of right of disposition and essence of human being, it is suggested that the new logic premise should be that the disposition of occupant often means that he has the right to do it.
