刑事补强证据规则有效适用的待证事实范围——以证明责任为视角

在证明责任有效履行视角下,待证事实在审前阶段可以分为侦诉两方有效履行和未能有效履行相对说服责任两类,在审判阶段可以分为控方未能有效履行说服责任,控方有效履行说服责任的待证事实且辩方未能有效履行动摇责任,以及控方有效履行说服责任的待证事实且辩方有效履行动摇责任三类。刑事补强证据规则在审前阶段适用于侦查机关、监察机关消极补充履行以及检察机关直接补充履行中因证明不足而暂时搁置的待证事实,在审判阶段适用于控方初步补充履行说服责任中控方自行发现或法庭指定的证明充分性不足的待证事实以及质证性补充履行说服责任中因辩方(或被害人一方)有效履行动摇责任导致证明充分性不足的待证事实。

From the perspective of burden of proof,facts to be proved in the pre-trial stage can be divided into two parties,that is investigators and prosecutors effectively and failed to fulfill relative burden of persuasion.At the trial stage can be divided into the prosecutors failed to fulfill the burden of persuasion,the prosecutors effectively fulfill the burden of persuasion and the defense failed to fulfill the burden of shake,and the prosecutors effectively fulfill the burden of persuasion but the defense effectively fulfill the burden of shake.The criminal corroboration requirement,in the pre-trialstage,is applicable to the facts that have been put on hold for lack of proof in the investigators and supervisors' negative supplementary perform and prosecutors' direct supplementary performe,and,at trial stage,is applicable to the facts that lack of sufficient proof,which found by the prosecutors or the cours,when the prosecutors temporarily fufill the burden of persuasion,and the facts that lack of sufficient proof,when the defense or the victim effectively fufill the burden of shake.
