摘取尸体器官涉及的刑法问题

摘取尸体器官构成侵犯尸体的犯罪,尸体解释为已经死亡的人的身体的全部或一部分较为妥当,我国目前不可以"脑死亡"的标准取代传统的"心肺死"标准。死者生前对于自己身体的处分权优越于其亲属和国家的占有和处分权。当存在某种违法性阻却事由时,摘取尸体器官的行为则不构成犯罪。

Harvesting Corpse Organs Related to Criminal Law

To harvest corpse organs belongs to the crimes of desecration of a corpse,it is appropriate for us to regard the corpse as the total or part of the dead body. Now the criterion of brain death can not take the place of the criterion of cardiac death in our country. the right of disposing the organs of the dead is prefer to the right of possession and right of disposing of the dead's immediate families and the nation,when there are the grounds for elimination of illegality,we should not regard harvesting corpse organs as crimes.
