| 摘 要： | 我国目前的土地承包经营权性质上是债权,物权化并不能够完全解决实践中存在的问题,关键在于物权法的制度选择。土地承包经营权应界定为法定物权,依照承包合同产生,无需登记。完善土地承包经营权是探索集体土地所有制改革的前提。

| Abstract: | The right of contracting of land is creditor's right,however,we can't solve the existing problems completely if the right of contracting of land is real right,and the institutional choice of real law is the key.The right of contracting of land should be defined legal real right,which is based on the contract and registration is unnecessary.Perfecting the right of contracting of land is the premise to probe the reform of the collective ownership of land in rural areas. |
