论我国行政听证制度的完善——以行政许可为视角

行政听证制度是我国立法确立的一项制度,它是行政程序法的核心。2004年7月1日实施的《行政许可法》对该制度作了专门规定,从而打破了过去一切事情由政府说了算的做法,真正体现了“让人民群众更广泛地参与社会公共事务的管理”的精神。然而,纵观《行政许可法》实施以来许可听证的执行情况,却出现了一些不尽如人意的地方,诸如许可听证流于形式,代表产生不够民主且不够广泛,没有严格遵循听证的原则和制度等。本文从行政许可听证的重大意义入手,剖析其制度缺陷以及在实施中存在的问题,试提出完善我国行政许可听证制度的合理化建议。

Perfection of the system of administrative hearing --from the viewpoint of administrative license

The system of administrative hearing established by legislation is the core of administrative procedure law.Administrative license law was implemented on July 1st 2004,which specially regulates hearing system and breaks the modus operandi that the government controls everything and really embodies the spirit that makes people widely take part in the public affairs management.However,in terms of implementation of administrative license law,there are a lot of unsatisfactory situations.For example,license hearing often only pays attention to formality,selected delegates are not enough democracy and popularity.Moreover,license hearing doesn't strictly follow the correlative principles and systems.This article begins with these significant meanings of license hearing and attempts to analyze the defects and some practical questions of license hearing.Furthermore,some reasonable suggestions to perfect the system are proposed.
