| 摘 要： | 高校管理者的自主权不是民事权利,而是法律授权和政府下放的准行政权力;学生的受教育权是 受法律保护的权利,剥夺这种权利(如开除)的理由应由法定,非依法不能被剥夺。

| Abstract: | The voluntary right of university administrator isn't civil right, but the law authorize and the government admit quasi administrative right;The reason that divest the students educated right (as be expelled for school) should be made by law,the educated right is the constitution right,it couldn't be divested except the law permission. |
