论社会中介组织的行政主体地位

社会中介组织发端于西方社会,是市场经济和政府"双失灵"的必然选择。作为沟通政府与社会的桥梁纽带,社会中介组织发挥着积极作用。特别在我国现阶段,社会中介组织的培育和发展,已经成为推动社会发展不可或缺的中坚力量。但是,由于受我国传统行政法理论的影响,在行政法学研究中,社会中介组织在行政法上的地位却不明确。本文拟从传统的行政主体理论入手,以公共行政理论为支撑,对我国社会中介组织的主体地位进行理论上的探讨。

On the position of administrative chief part of social median organizations

Social intermediate organization,arising from western countries,was the certain choice as both market economy and government lost control on economy or society.Being intermedium between government and society,social intermediate organizations play important roles in communication.In china,social intermediate organizations have become the necessary force to promote the social development with their gradually founding and developing.However,their status in administrative law is not definite under the influence of traditional theory on administrative law,and brings so many legal problems.The paper begins with analyzing the traditional theory on administrative subject,and then tries to adjust the status of social intermediate organizations in national administrative law,based on public administration.
