浅论设立NGO工作人员职务型经济犯罪规制条款之必要性

NGO(Non-Governmental Organization)是一种非赢利性、非政府、自愿自治的正规化民间公益组织,在当代社会具有广阔发展前景。现今的NGO大致可分为“自上而下型”、“自下而上型”和“上下结合型”三类。但任何概念都仅是语境化的概念,受传统观念限制,我们对NGO工作人员职务型经济犯罪研究较少,可实质上它却具有极大社会危害性,有必要在我国刑法中设立有关NGO工作人员职务型经济犯罪的规制条款。

The Necessities for Setting up a Series of Regulations Clauses for the Economic Crimes by Taking Advantage of Duty in NGO

NGO is a kind of non-profit,non-governmental and guarantee formal group.It has widely prospects in the modern society.We can divide NGO into three categories: "the up to down","the down to up" and "the up between down".But all concepts have their linguistic backgrounds.Because traditional theories limited our ideas,we researched the economic crimes by taking advantage of duty in NGO very fewer.In fact,it has very large bad effects in all kinds of the society.This article will use a method of jurisprudence to study the department law issue.From the view of concept,it really has bad effects of the economic crimes.I think it is important to set up a series of regulations clauses for the economic crimes by taking advantage of duty in NGO.
