建筑物区分所有权之专有所有权研究

摘    要:建筑物区分所有权是一项重要的不动产物权。业主的建筑物区分所有权,包括了3个方面的基本内容:专有所有权、共有所有权和成员权。它们既是相对独立的权利,又是一个不可分的整体蠢而专有所有权作为其中的占主导地位的权利,是作为制度的区分所有权的单独性灵魂一我国物权法及最高人民法院法释2009]7号文中对专有所有权的性质、范围及侵害专有所有权的救济方式进行了规定。

Abstract:Divisional ownership of building is an important real estate propertyl The divisional ownership of building of proprietor includes: proprietary ownership, mutual ownership and member o,ownership. Property Law of China and Legal Explanation 2009]7 of the Supreme People's Court of PRC regulate the eharacteristlcs, scale and redress ways of trespassing proprietary. ownership.
