| 摘 要： | 文章集中研究中国检察权，即法律监督权的价值与功能。主要从现实检察理论研究中的方法论的检视与分析入手，深入分析在检察理论研究方法中引进价值方法论和功能方法论的必要性和可行性；在此基础上，着重分析法律监督本身的价值蕴含，以及在积极的价值观的导引和价值预期下，如何更自觉、更积极地强化和完善国家的法律监督机关的建设和更高效地实现国家法律监督的功能。文章的学术创新之处在于，从全新的价值论、功能论及其方法论视角探讨中国国家检察制度建构和强化的合法性和必要性，以及法律监督功能实现的价值基础。
