人权重要还是财产权重要,如何认识民事权利体系的变迁,概念法学是否能够容纳开放性的民事权利体系等都是民法理论中的热点问题。本文运用经济学的知识结合经济基础的变迁给出了对民事权利的全新认识,并在此基础上回答了上述问题。最后,论文从方法论的角度回答了概念法学应当如何被超越的问题。

From Possessing Individualism to Compatible Individualism --Economic Analysis of Civil Rights

Which one is more important, human rights or property rights? How to review the transformation of civil rights system? Can the conceptualist jurisprudence be compatible with an open civil rights system? These are all hotspot problems in civil law theory. The paper herein employs economic knowledge and gives thought on the transformation of economic basis to bring a brand-new view of the civil rights, on which basis the former problems are analyzed at the same time. In the end, the paper answers the question of how the conceptualist jurisprudence should be surpassed in the view of methodology.
