论我国知识产权边境保护立法的推进

我国的知识产权边境保护制度经过十几年的发展,取得了显著的成绩。然而,随着经济的发展,一些原已存在的立法空白又导致许多新问题的产生。这些问题表现为：边境保护客体范围难以适应边境保护的需要、保护程序单一以及对利用边境保护程序进行不正当竞争的行为缺乏规制等。针对这些问题,我国需要提升知识产权边境保护制度的立法层级,进一步完善边境保护制度的实体法与程序法,以期能更有效地抑制知识产权进出境侵权行为。

The Improvement of Legislation of China's IPR Protection at Border

In the past two decades, China＇ s IPR protection at border has made great progress. However, with economic development of China, the relevant legislation still has some weaknesses and problems. The problems include： the narrow objects scope unsuitable to the current economic circumstances, the simple design of the procedure inconsistent with diversified characters and demands of IPR protection at border, and iUegal use of protection procedure for unfair competition, etc.. To tackle the problems abovementioned, China needs to undertake necessary actions for advance of the hierarchy of IPRs customs protection system, and for improvement of procedure and substantive law of the IPR protection at border system, that once implemented, will fundamentally decrease the infringements on IPR at the country＇s borders.
