刑讯逼供现状调查报告——以监狱服刑人员为调查对象

为了解在押服刑人员未决羁押期间的刑讯逼供现状及其主观认知状况,开展了此次调查。调查表明,公安机关侦查案件时,存在着大量的刑讯逼供行为;公诉阶段检察人员较少使用刑讯逼供;变相刑讯逼供较直接刑讯逼供更为普遍,且在职务犯罪侦查中较容易出现;男性遭遇刑讯逼供的比例高于女性;受教育程度较低的犯罪嫌疑人较容易遭遇刑讯逼供;侵犯财产犯罪更易遭遇刑讯逼供;在押犯中不存在"反直觉现象"。为预防刑讯逼供,建议提高物证技术水平,降低口供作用;对财产类犯罪采取更有效的预防措施;加强对弱势群体的法律援助。

Investigation Report of Current Situation of Extorting Confessions by Torture

In order to know the current situation of extorting confessions by torture about prisoners in the period of unsentenced custody and their subjective cognition,we take this investigation.The investigation data show： there exist phenomena of extorting confessions by torture in criminal cases investigation by public security organs;the procurators use less of extorting confessions by torture in the stage of review and prosecution;the extorting confessions by torture in disguised form which appears preferentially in investigation of crime by taking of advantage of duty,is more popular than the extorting confessions by torture directly;the percentage of male extorted confessions by torture is higher than female;the criminal suspect with low level of education is easier to be extorted confessions by torture;the crime against property is easier to encounter extorting confessions by torture;there doesn＇t exist anti-intuition phenomenon of prisoners.According to survey analysis,we suggest to improve technique of physical evidence,reduce effect of confession,take more efficient preventive measures to crime against property,strengthen legal aid to disadvantaged groups and so on.
