| 摘 要： | 现代产品责任归责原则应该是一般性侵权归责原则和作为其外化形式的产品缺陷的认定标准的有机统一。亦即：现代产品责任归责原则乃是以产品缺陷的认定标准为主要内容、以一般性侵权归责原则的基本范畴为价值取向和精神内核的、用以确定生产者因产品缺陷致损而应承担的赔偿责任的根据和标准。
