论预告登记制度的不足及完善

预告登记是为了保全以不动产物权的得丧变更为标的之债权请求权而设立的一项登记制度,经由此种登记,债权请求权得以对抗第三人。这对于保障债权人的权利、维护交易安全、维护市场信用具有重要作用。但是《物权法》的规定过于概括不利于司法适用;内容缺漏不利于发挥预告登记制度的作用;程序上缺乏可操作性。应当结合我国自身情况,从细化适用范围、补全效力内容及增加操作程序三个方面去完善预告登记制度。
