对强迫交易罪之“强迫交易”的多维解构

强迫交易是社会主义市场经济发展的异化现象,可以用道德、民法、行政法以及刑法等多种手段来控制。鉴于刑法原有规定对新近强迫交易行为规制的不力,刑法修正案（八）扩充了强迫交易的入罪范围,加重了强迫交易罪的法定刑,该罪的罪体、罪责和罪量等构成也相应发生变化。用刑法思维处理强迫交易时要理性客观、张弛有度,对恶劣行为要严惩,对一般行为要宽缓。

Multiple Deconstruction on Forced Transaction of the Forced Transaction Crime

The forced transaction is a deviant phenomenon,which is under control by multifarious means such as morality,Civil Law,Administrative Law,Criminal Law and so on.Owing to the weakness of the previous rules of Criminal Law that regulated new forced transactions,the Criminal Law Amendment（Ⅷ） expanded scope of the Forced Transaction Crime and increased statutory punishment.Simultaneously,the corpus delicti,culpability and severity of the Forced Transaction Crime altered.To deal with forced transaction by thoughts of Criminal Law should be rational,objective,flexible and abstinent.Therefore,egregious conducts of forced transaction must be punished severely,and ordinary acts of forced transaction must be disposed gently.
