未成年人犯罪矫治的恢复性司法模式构建

恢复性司法旨在恢复因犯罪行为引起的被害人、被告人和社区创伤，恢复平等、和谐的社会关系和秩序。未成年人恢复性司法模式与我国未成年人司法“双保护”及“教育为主、惩罚为辅”原则是统一的。“双保护”原则是我国未成年人司法制度的首要原则，基本含义是未成年人司法既要注重社会的安全、秩序，也要注重保护失足未成年人，并使二者有机结合。未成年人犯罪恢复性司法矫治体现了刑法谦抑主义所提倡的“非刑罚化”的刑事政策。刑法谦抑主义包括：一是刑法的补充性；二是刑法的不完整性；三是刑法的宽容性。通过恢复性司法，犯罪人将不用承受牢狱之苦，而由其他方式如赔偿损失、社区劳动等来代替刑罚的执行。

Restorative Justice Mode Construction of Juvenile Crime Correction

The purpose of Restorative Justice is to restore ravage of the victims,appellee,community,equal and harmonious social relationship and order. Juvenile restorative justice mode is coincided with principle that education is more important than punishment,and with juvenile justice. Double Protection is the chief principle in juvenile justice system,which means that juvenile should pay attention to social security and order,in reverse,we should protect wayward young.
