摘    要:回溯我国的劳动立法进程和检讨其缺失,考察劳动者组织模式演进和进行相关比较分析,可以认为相关的理念更新和策略调整有助于劳动者状况的改善.这包括认识劳动者的能动作用而使相关的法制建设与之相协调,克服盲目依赖法律的信仰而致力于法与劳动者诉求的沟通,工会则应立足自身的改革和建设并以此推动劳动者权益的实现.

Abstract:To review the course of labor legislation in China and its imperfect parts,to look back the development of patterns of laborer's organization and to make related comparative research,we can find out that the innovation of values and the adjustment of strategy will be helpful to improve laborer's situations.Trade unions should keep a foothold in self-reform so as to promote the realization of labor rights and interests.
