| 摘 要： | 德国1992年立法为其乔装侦查的证据转化提供了三条可行途径,即传闻证据规则、犯罪情报到证据的转化以及线人替代出庭作证。其为我国实施卧底侦查证据转化提供了借鉴,在卧底侦查法制化,传闻证据规则的特殊适用,推进证据—情报—证据的转化模式和慎用秘密力量替代的转化途径等方面有所启示。

| Abstract: | The German in 1992 supported three feasible approaches for the evidence of disguise investigation,including hearsay rule,criminal intelligence being transformed to evidence and informer putting testify in court.It takes some references for us undercover investigation implementing,including undercover investigation of legalization,the hearsay rule for special use,evidence-intelligence-evidence transforming models and secret force being careful used. |
